Requirements Needed to Prove Negligence
To have a personal injury case, you will need to be able to prove by a preponderance of the evidence—meaning that it was more likely than not– that another person or entity was negligent. To do this, you will need to satisfy the following four criteria:
- You were owed a duty of reasonable care. Perhaps you were driving on the highway, shopping at the grocery store, or attending a friend’s backyard cookout. In these examples, it is reasonable to assume that you will be safe.
- This duty of care was breached. In general, the defendant owes you a duty to act reasonably and avoid injuring you. Examples of breaches of this duty can include driving while under the influence of alcohol or drugs, which is unreasonable and unsafe for all parties involved.
- This breach is what caused your accident. Perhaps the drunk driver ran into your vehicle after running a red light.
- You must have been physically or emotionally injured in this accident, so mere property damage is not sufficient. You may have sustained a severe spinal cord injury in the above-referenced drunk driving accident.
