Both New York and New Jersey have adopted the no fault insurance law. The no fault insurance law says that your own insurance company will pay for your medical bills and lost wages regardless of who was at fault in the accident. It doesn’t matter if you are hit from behind or if you drive your car into a tree, your insurance company will pay your medical bills and lost wages. If you’ve got a serious injury as that defined under the insurance law, you can make a claim against another driver if they were responsible for the accident.
