Medical malpractice is professional negligence. Negligence is failing to adhere to the standard of care. When a doctor does something that a reasonably prudent doctor wouldn’t do or fails to do something that a reasonably prudent doctor would do, that doctor can be deemed to be negligent. But to be able to recover for malpractice, that negligence has to cause a harm. There has to be negligence that results in damage to be able to bring a claim for medical malpractice.
