Existing agreements or judgements of divorce entered into prior to January 1, 2019, will allow the spousal support to be tax-deductible. However, new agreements entered into after January 1, 2019, pursuant to the latest tax law changes, will not be tax-deductible whether you agree to it or not, or whether a judge sets it in a judgment of divorce.
