A business, if it was built or grew during the term of the marriage, is subject to equitable distribution. Equitable distribution gives the judge the authority to value the business, value the marital portion, and determine what percentage, if any, should be given to a spouse. They won’t give you a percentage of the business itself. They will give you a value instead. That may be in a direct payment of money or in other assets of the marriage.
