Under New York’s labor law, owners and general contractors are strictly liable for injuries sustained by workers who fall from a scaffold, a ladder, or an other elevated platform. So if you’re injured in a construction accident that involves a fall from a height, you have a claim against the owner and the general contractor. If you’re employed by either of those, there would have to be another party that would be liable for your fall.
