When you have a complaint and you bring it to an attorney who is interested in looking at it as a class action lawsuit, he wants to know that it meets certain criteria that the court will look at to determine whether it’s a class action. That would be numerosity, are there a large number of people who have the same problem, is it a common problem that a number of people have? Is the common problem predominating over certain individual issues? Would you be a typical plaintiff in the case and is the class of people ascertainable? Can we find people who would be potentially in that class? And those would be he areas we would want to look at initially.
