KGG Investigates TRESemmé for Failure to Warn Consumers About Hair Loss Risks

What Causes TRESemmé Scalp Irritation and Hair Loss?

KGG Law is currently investigating allegations that Unilever United States Inc. and Conopco Inc. created the product using a preservative called DMDM hydantoin, which is known to leach formaldehyde when it comes into contact with water. This effect purportedly caused scalp irritation, hair follicle brittleness, and significant hair loss in potentially thousands of users.  

Failure to Warn

KGG Law class action attorneys are investigating claims that TRESemmé customers were injured through no fault of their own by using the product “as directed.” They were not warned of any risk, let alone serious side effects like hair loss or scalp irritation. The product label mentioned DMDM hydantoin, but nowhere does it list formaldehyde. Consumers were not warned that using the product could put them into contact with formaldehyde, a human carcinogen linked to cancer and other harmful reactions when absorbed into the skin.

Despite complaints, the defendants have failed to recall the products or add warnings to the labels.  

Defective Design

Consumers who contend that the TRESemmé Keratin shampoos have defective designs claim that the use of DMDM hydantoin is unnecessary, since safer alternatives exist. DMDM hydantoin is used to prevent microorganism growth and extend shelf life. However, the US Food and Drug Administration considers DMDM hydantoin to be one of the top allergens causing “the most allergic reactions from the use of cosmetic products.”

Users can become more sensitive to the chemical as time passes, they warn. Vitamin E, tea tree oil, grapefruit seed extract, and other antioxidants are all more natural preservatives that could be used instead.  

Unilever has known of dangers associated with DMDM hydantoin for more than a decade, given that they’ve been the defendant in prior litigation. Complaints of hair loss and scalp irritation associated with their “formaldehyde-free” Suave Keratin Infusion shampoo led to a 2012 recall and a $10.2 million settlement that was ultimately upheld in an appeals court in 2016.

Unilever adamantly defended their decision to use DMDM hydantoin and publicly asserted that the chemical was safe for use in hair products.

False Advertising

Unilever marketed its Keratin Smooth line of shampoos to women who wanted “smooth, shiny, manageable hair with no frizz.” The desired result could best be achieved through the application of keratin, a natural protein that “deeply nourishes, gently cleanses, and repairs the hair.” Consumers say they felt misled that they would have noticeably silkier, shinier, salon-quality hair after using the product – not irritation and hair loss.
