KGG is currently representing a putative class of customers and homeowners in Connecticut against Connecticut Light and Power d/b/a Eversource Energy (“Eversource”) in a class action which asserts that Eversource was negligent, and/or reckless, and violated the consumer protection laws of Connecticut based upon its handling of tropical storm Isaias, which struck Connecticut on or about August 4, 2020.

The action seeks to recoup funds for Connecticut residents who lost power during the approximately ten (10) day period after the storm hit the territory which Eversource services.

KGG Moves Forward With Eversource Class Action Litigation

KGG is acting as co-counsel for plaintiffs seeking class action certification of claims asserted on behalf of all homeowners and business owners in Connecticut serviced by Eversource for damages resulting from a loss of power to their homes and places of businesses following Isaias. The action claims that Defendant failed to take appropriate effective measures to prevent the interruption of electric service resulting from the storm.

Defendant CL&P moved to strike the claims of recklessness and consumer protection (brought under Connecticut Unfair Trade Practices Act (“CUTPA”)). On December 2, 2022, the Court issued an opinion denying Eversource’s motion and sustaining both the recklessness claim and the claim asserting a CUTPA violation, allowing them to move forward.
