The attorneys at the law firm of Kantrowitz, Goldhamer & Graifman, P.C. recently achieved a victory for our client, a father of three children, engaged in a long-term child custody battle regarding parental alienation.
Our client had been subjected to heinous and false charges by the mother of his children over a 10-year period, including false allegations of sexual and physical abuse, false criminal charges by the mother that were always dismissed and unfounded child protective services reports filed by the mother.
The court determined that all the allegations were unfounded after hearing testimony from witnesses, including an objective expert child psychologist, testifying that the mother was alienating the children from their father.
It should be noted that New York courts have consistently held that a pattern of making false Child Protective Services allegations by a custodial parent against a non-custodial parent are not only grounds to change custody, but also rises to the level of child neglect. In our case, the judge determined that the best interest of two younger children would be to modify the custody, so that our client is now named the primary physical custodian of his children.
The judge also ordered the father to take the children to counseling and suspended any contact with the two younger children and the mother for 30 days. The oldest child would remain in the mother’s custody. Although courts are generally hesitant to split custody of siblings, it does happen in certain rare situations.
Parental alienation is unacceptable. Most psychologists and mental health experts agree that this behavior is damaging to a child’s mental and emotional well-being. It can also cause long-lasting problems when a child reaches adulthood and moves into a committed relationship, as issues involving trust peak.
