The Firm is investigating a design defect claim involving the BMW 5 Series Tire Jack (E39). The Jack is allegedly unstable, wobbly and excessively dangerous and difficult to use or hold steady during operation. The Jack design makes it excessively difficult to insert and keep the jack head in the jack mounts (which are square recesses located underneath the vehicle) while cranking the Jack. The Jack design also exerts lateral forces on the jack head, moving it away from the jack mount. If the vehicle is lifted and the jack head moves away from the jacking point, the vehicle may drop down and cause serious personal injury. Furthermore, the instructions provided with the vehicle and Jack do not include instructions or warnings about this risk or any manner to prevent such injury.
