Before a divorce case can move forward in New Jersey, it has to be filed in the right place by someone who meets the state’s residency rules. Getting those basics wrong can delay everything that follows. People in Bergen County raise several questions about where and when to file.
Who Can File for Divorce in New Jersey?
According to the New Jersey Courts divorce self-help page, at least one spouse must live in New Jersey to file for divorce. The page also explains which grounds a filing can state and which county the case belongs in. A spouse who lives elsewhere can’t file here unless the residency rules are met.
How Long Must a Spouse Live in New Jersey First?
For a divorce based on irreconcilable differences, one spouse must have lived in the state for 12 consecutive months before filing. That requirement counts the months before the filing date, so someone who moved here recently may need to wait. Residency can be shown with a lease, a mortgage statement, or a driver’s license, which is why those documents are worth locating early.
Which County Hears the Case?
A divorce is filed in the New Jersey county where the spouses lived when they separated. If the filing spouse doesn’t live in New Jersey, the case goes in the county where the other spouse lives. For couples who formed a civil union or partnership in New Jersey but now live elsewhere, the court allows filing in the county where it was formed.
The starting point is where the spouses lived at separation, and not necessarily where each lives now. Spouses who lived in Bergen County when they separated would file there, and a Bergen County divorce lawyer can confirm the proper county before any papers are submitted.
What Grounds Does a Filing Have to State?
The filing must state a ground recognized by New Jersey law. The court’s page lists these:
- Irreconcilable differences, which must have lasted six months
- Separation of at least 18 months
- Extreme cruelty
- Adultery, institutionalization, or extended incarceration
Irreconcilable differences is the no-fault ground, and the court’s page says no accusation of wrongdoing is needed for it. The difference between no-fault and fault grounds affects how a case is presented, even when the end result is the same.
What Should Be Gathered Before Filing?
A few records help establish the basics:
- The date of the marriage and the date the spouses separated
- Proof of New Jersey residency
- Recent tax returns and pay records
- Statements for bank, retirement, and investment accounts
Those financial records will be needed later, once the court asks for each spouse’s financial disclosure. Starting early keeps the process organized.
How Long Does a Case Take After Filing?
The answer depends on whether the spouses agree on custody, support, and property. Open disputes add time that a settled case doesn’t need. Readers who want a sense of the range can look at how long divorce takes in practice. Telling a spouse is its own step. A plan for telling your spouse in advance can lower tension at the outset.
Does Filing Also Involve Children and Support?
When a couple has children, custody and parenting time come before the court alongside the divorce itself. Parents can ask a Bergen County child custody lawyer how those issues are raised in the same case. Support is also part of the picture. Parents can ask a Bergen County child support lawyer how support is set and enforced.
How Does Our Firm Approach Divorce Filings?
Kantrowitz, Goldhamer, Graifman, Perlmutter & Carballo, P.C. was co-founded in 1975, and family law has been part of our work from the start. Partner Randy J. Perlmutter has practiced for more than 20 years, was admitted to the New Jersey bar in 2000, and focuses on divorce and family law. What Should You Do Before Filing in Bergen County?
Write down the date you separated, collect proof of where you have lived, and confirm which county applies. If you’re unsure whether you meet the residency rules, you can speak with us before anything is filed, and a Bergen County divorce lawyer can check the dates against the court’s requirements.

KGG Law, and Barry Kantrowitz in particular, set the bar high for what a thorough, practical, strategic, compassionate and smart lawyer can be. Everything about Barry's advice and representation was exemplary and the stress mitigation that resulted was invaluable. On top of that, the ultimate result Barry achieved was beyond what was reasonable to expect and we are forever grateful. Often, people say that you hire a lawyer to prevent a problem. Sometimes, unfortunately, you need an attorney to solve a problem and I could not recommend Barry and his firm any more highly in that regard.Posted on Google

Kate Carballo is a dedicated, passionate, and creative attorney whom I had the pleasure to lecture with at a state trial lawyer's conference. Kate's lecture demonstrated how she uses her innovative and "out-of-the-box thinking" to achieve outstanding results for her injured clients. That Kate is certified by the Supreme Court of New Jersey as a civil trial attorney is a testament to her skills, experience and commitment to excellence.Posted on Google

Was referred to KGG law by a friend and could not have asked for better legal representation. They walked me through every step of the process after my accident and began every call with “ how are you feeling” which was just one example of how much they care about their clients. They handled my case very efficiently, professionally and courteously. My attorney Kate Carballo was a rock star! So clearly experienced, she consistently made me feel at ease with the process. We had a great experience with the team at KGG Law. While it was a traumatic time for our family, they made it very easy for us and explained all of our options. They even performed due diligence to make sure that after our settlement, there would be no further issues which I think is even more important than the settlement itself. Thank you!
