What are the Overtime Laws?

The Fair Labor Standards Act (FLSA) governs overtime pay; state laws may also apply to your workplace. The FLSA requires that nonexempt employees be paid one and one-half times their regular pay rate for all hours worked in excess of 40 per week. Are You Misclassified as a Salaried Employee or Independent Contractor?

Employers may try to avoid paying overtime wages by misclassifying or reclassifying employees as salaried (exempt) when they should be paid hourly (nonexempt). If you are a nonexempt worker who is not being paid for your hours in excess of 40 per week, your employer may be violating state and federal overtime wage laws. There are very specific conditions that must be met for an employee to be exempt; we will evaluate your case to determine whether you have been misclassified.
