Employment Lawyers Uphold Employee Rights

At KGG, our employment attorneys work to protect employees from unfair wage practices. If your employer has violated the law, we can file a class or collective action against the company. If the suit is successful, the court may order the employer to pay back payment for overtime wages, attorneys’ fees and additional expenses.

We understand that having a complaint against your employer can be a stressful situation on a day to day basis. Our experienced team will work with you to resolve your issue as quickly and efficiently as possible. In the event negotiations are not fruitful, we will aggressively represent you in the courtroom.

What are the Overtime Laws?

The Fair Labor Standards Act (FLSA) governs overtime pay; state laws may also apply to your workplace. The FLSA requires that nonexempt employees be paid one and one-half times their regular pay rate for all hours worked in excess of 40 per week. Does your employer force you to work more than 40 hours per week and refuse to pay you overtime wages?

Are You Misclassified as a Salaried Employee or Independent Contractor?

Employers may try to avoid paying overtime wages by misclassifying or reclassifying employees as salaried (exempt) when they should be paid hourly (nonexempt). If you are a nonexempt worker who is not being paid for your hours in excess of 40 per week, your employer may be violating state and federal overtime wage laws. There are very specific conditions which must be met in order for an employee to be exempt; we will evaluate your case to determine if you have been misclassified.

What are Common Overtime Pay Violations?

  • Giving meaningless job titles to workers to make it seem as if they are exempt from overtime laws
  • Using illegal averaging techniques when calculating work hours
  • Not counting all work time, such as travel time between jobs, when calculating overtime pay
