NOTICE TO SPONGETECH SHAREHOLDERS

Pursuant to a Settlement between the Securities and Exchange Commission (“SEC”) and one of the defendants that the SEC had been prosecuting in connection with the Spongetech case, a Plan of Distribution has been submitted which proposes to distribute funds obtained in the Settlement with that defendant. A Distribution Plan and Notice packet can be located on the following website: www.weinerdistributionfund.com. That site was established by the SEC’s Claims Administrator to distribute the fund. The Distribution Plan is available at that website as well on the SEC’s site at the “Information for Harmed Investors” page at the www.SEC.gov site.
