The firm is currently litigating a putative class action involving an alleged defect in the TURBOCHARGER for certain VOLKSWAGEN and AUDI 1.8L and 2.0L vehicles, model years 2008 through 2014, equipped with an exhaust gas turbocharger. Class vehicles include but are not limited to the following Volkswagen vehicles: Beetles, CC, Eos, GTI, Jetta, Passat, Tiguan. Audi class vehicles also include but are not limited to: A3, A4, A5, A6, TT, Q5.

This suit alleges that the defect in the exhaust manifold and turbine side of the turbochargers create vibrations that can prematurely wear out the wastegate, causing it to become nonfunctional. This suit seeks reimbursement of the cost of repair and replacement of the turbochargers and/or diminution of value of vehicles. Additionally, the suit alleges Audi and Volkswagen knew about the defects through pre-production testing, design failure mode analysis, consumer complaints, warranty and replacement data from dealerships, and other information known to the automakers yet concealed this defect from consumers. The complaints indicate owners have experienced this defect shortly after the limited powertrain warranties expire.
