The law firm Kantrowitz, Goldhamer, Graifman, Perlmutter & Carballo, P.C. (“KGG”) has filed a putative class action against auto manufacturer Ford Motor Company concerning its Lincoln brand Corsair vehicles, model years 2021 through 2025 (“class vehicles”).
The suit alleges that Lincoln/Ford represented that the class vehicles were capable of being “flat towed.” This method is the gold standard for long-distance travelers because it allows the vehicles to be towed naturally and effortlessly behind an RV. The class vehicles were marketed and sold as possessing flat tow capability through owners’ manuals, marketing materials, and pre-sale representations. However, Ford/Lincoln has recently issued a recall relating to a software defect which has the effect of removing the software that allows flat tow capability of the class vehicles, and therefore removes that ability.
