After a death caused by someone else’s negligence, a family wants to know who receives the money from a successful claim. New Jersey answers that question in its Wrongful Death Act. The answer isn’t always what people assume, and it affects how families plan.
Who Receives the Recovery
New Jersey Statutes section 2A:31-4 says the amount recovered is for the exclusive benefit of the persons entitled to take any intestate personal property of the decedent. They take in the same proportions that they would take that property. That means the recovery follows the intestacy pattern rather than the terms of a will.
A Surviving Spouse and Descendants
The statute addresses a surviving spouse and at least one surviving descendant directly. In that situation, it sets equal shares for purposes of the recovery, notwithstanding Title 3B. Families should understand that this rule applies to the wrongful death recovery specifically, and that it can differ from what they expect from an estate.
Dependents Are Treated Differently
The statute gives special treatment to dependents of the decedent. Dependents at the time of death are treated as though they were the sole recipients. A court, not a jury, sets their shares to reach a fair and equitable apportionment.
The court considers factors such as ages, physical and mental condition, educational needs, financial condition, and other available support. Those factors mean the records of a dependent’s circumstances matter. A child’s school costs or a parent’s medical needs can be part of the picture.
Records That Support Dependents
Families who expect a court to divide a recovery should keep the records that show who relied on the decedent. The statute asks the court to weigh need, so a clear record helps the court see it. Useful documents include:
- Proof of the decedent’s income and household role
- School and tuition records for children
- Medical records for a dependent with special needs
- Proof of other available support
- Funeral and burial invoices
Gathering these early prevents a scramble later. Dated records are best, and originals should stay somewhere safe. A family that organizes them at the start has less to reconstruct when the court asks.
Questions That Arise Along the Way
Families make avoidable errors in the first weeks. Reading about wrongful death mistakes helps a family avoid them. Some errors involve statements to insurers, and others involve missed paperwork or late requests for records.
The structure of a case is easier to follow with a roadmap. Learning the steps in a lawsuit shows where distribution comes in, and payment follows the end of the case. Knowing the order helps a family set expectations.
Deadlines also matter. A guide to New Jersey filing deadlines explains how time limits work in injury cases. Anyone with a wrongful death question should confirm the deadline early, since a missed date can end the claim.
Hackensack Families and Related Claims
Our Hackensack wrongful death lawyer team works with families on the claim itself and on the records that support each dependent. We also explain how the court may divide a recovery. That explanation helps families set expectations.
Fatal crashes are one source of these claims. Clients who lost someone in a collision can work with our Hackensack car accident lawyer team, which reviews the crash report and the evidence. The same recovery rules apply once a fatal claim succeeds.
Commercial vehicles can cause fatal crashes as well. Our Hackensack truck accident lawyer team examines the carrier’s records, and those records can show who bears responsibility. Logs and inspection reports are part of that review.

KGG Law, and Barry Kantrowitz in particular, set the bar high for what a thorough, practical, strategic, compassionate and smart lawyer can be. Everything about Barry's advice and representation was exemplary and the stress mitigation that resulted was invaluable. On top of that, the ultimate result Barry achieved was beyond what was reasonable to expect and we are forever grateful. Often, people say that you hire a lawyer to prevent a problem. Sometimes, unfortunately, you need an attorney to solve a problem and I could not recommend Barry and his firm any more highly in that regard.Posted on Google

Kate Carballo is a dedicated, passionate, and creative attorney whom I had the pleasure to lecture with at a state trial lawyer's conference. Kate's lecture demonstrated how she uses her innovative and "out-of-the-box thinking" to achieve outstanding results for her injured clients. That Kate is certified by the Supreme Court of New Jersey as a civil trial attorney is a testament to her skills, experience and commitment to excellence.Posted on Google

Was referred to KGG law by a friend and could not have asked for better legal representation. They walked me through every step of the process after my accident and began every call with “ how are you feeling” which was just one example of how much they care about their clients. They handled my case very efficiently, professionally and courteously. My attorney Kate Carballo was a rock star! So clearly experienced, she consistently made me feel at ease with the process. We had a great experience with the team at KGG Law. While it was a traumatic time for our family, they made it very easy for us and explained all of our options. They even performed due diligence to make sure that after our settlement, there would be no further issues which I think is even more important than the settlement itself. Thank you!
