What Is the Verbal Threshold in New Jersey?
The verbal threshold, also called the Limitation on Lawsuit option, is a choice New Jersey drivers make when purchasing auto insurance under the Automobile Insurance Cost Reduction Act. Choosing this option lowers your premium but restricts your ability to sue for pain and suffering unless your injury meets one of six specific legal categories.
This tradeoff between cost and legal rights is not always obvious to drivers shopping for insurance, since the lower premium often gets emphasized far more prominently than the corresponding restriction on future lawsuit rights.
What Are the Six Qualifying Injury Categories?
Under N.J.S.A. 39:6A-8, a driver who chose the Limitation on Lawsuit option can only sue for pain and suffering if the injury involves death, dismemberment, significant disfigurement or scarring, loss of a fetus, a displaced fracture, or a permanent injury that has not healed and will not heal to normal function with further treatment. A Ramsey personal injury lawyer reviewing a potential claim checks each category carefully against the medical record.

- Dismemberment
- Significant disfigurement or scarring
- Loss of a fetus
- A displaced fracture
- A permanent injury that will not heal with further treatment
What Is the Alternative to the Verbal Threshold?
New Jersey drivers can instead choose the No Limitation on Lawsuit option, sometimes called Zero Threshold. This choice preserves an unrestricted right to sue for pain and suffering regardless of injury severity, though it generally comes with a higher insurance premium than the verbal threshold option.
Did I Actually Choose This When I Bought My Policy?
Yes, whether you remember doing so or not. Every New Jersey auto insurance policy requires the policyholder to select one of these two options, and many people make this choice online without fully understanding what it means for a future claim. A Ramsey personal injury lawyer can confirm that reviewing your actual policy documents remains the only reliable way to determine which specific option you selected.
Which Category Causes the Most Disputes?
The permanent injury category generates by far the most litigation, since determining whether an injury has genuinely failed to heal to normal function, and will not heal with further treatment, often requires detailed medical evidence and outside opinion. Soft tissue injuries in particular tend to fall into this contested territory.
Insurers frequently challenge permanent injury claims by pointing to gaps in treatment, conflicting medical opinions, or diagnostic imaging that does not clearly show a lasting problem. This is why the quality and consistency of medical documentation matters so much once a claim depends on this specific category.
What Kind of Medical Proof Do I Need?
If your injury falls under the verbal threshold, you generally need to provide a certification from your treating physician, or a physician to whom you were referred, stating under penalty of perjury that your injury meets one of the statutory categories. An attorney handling this kind of claim typically coordinates directly with treating physicians to make sure this certification is based on objective clinical evidence, including appropriate medical testing.
What Happens if I Cannot Meet One of These Categories?
If your injury does not fall into one of the six categories and you selected the verbal threshold, you generally cannot recover pain and suffering damages from the at-fault driver, even if the accident was entirely their fault. You may still be able to recover economic damages that exceed your basic no-fault coverage, depending on the specifics of your situation.
Does the Verbal Threshold Apply to Passengers Too?
Generally, yes, if the passenger is covered under a policy that selected the Limitation on Lawsuit option, though the specific analysis can depend on whose policy actually provides coverage in a given accident. Passengers should review the relevant policy details rather than assuming their own coverage automatically controls the outcome.
Who Can Help Determine Whether My Injury Qualifies?
An attorney reviewing a case evaluates the medical evidence closely to determine whether an injury genuinely meets one of the statutory categories, since a properly supported permanent injury certification can be the difference between a limited recovery and full compensation.
Who Handles These Claims for Ramsey Residents?

KGG Law, and Barry Kantrowitz in particular, set the bar high for what a thorough, practical, strategic, compassionate and smart lawyer can be. Everything about Barry's advice and representation was exemplary and the stress mitigation that resulted was invaluable. On top of that, the ultimate result Barry achieved was beyond what was reasonable to expect and we are forever grateful. Often, people say that you hire a lawyer to prevent a problem. Sometimes, unfortunately, you need an attorney to solve a problem and I could not recommend Barry and his firm any more highly in that regard.Posted on Google

Kate Carballo is a dedicated, passionate, and creative attorney whom I had the pleasure to lecture with at a state trial lawyer's conference. Kate's lecture demonstrated how she uses her innovative and "out-of-the-box thinking" to achieve outstanding results for her injured clients. That Kate is certified by the Supreme Court of New Jersey as a civil trial attorney is a testament to her skills, experience and commitment to excellence.Posted on Google

We had a great experience with the team at KGG Law. While it was a traumatic time for our family, they made it very easy for us and explained all of our options. They even performed due diligence to make sure that after our settlement, there would be no further issues which I think is even more important than the settlement itself. Thank you!
