The tragic Metro-North Railroad train derailment that occurred in the Bronx on December 1, killed four people and injured more than 70 passengers.

According to the most recent news reports, the train was traveling in excess of 80 miles per hour approaching a turn with a 30 mile per hour limit.  So far, publicly disclosed reports indicate that the derailment was the result of operator error.  The Engineer recently admitted to “dozing” while at the controls of the commuter train.  The NTSB is still investigating and reviewing the data from the “black box” data recorder on board.

A former Rockland County resident and two of her friends visiting from Houston Texas were passengers on the train and have retained Barry Kantrowitz of Kantrowitz, Goldhamer  & Graifman, PC in connection with their claim for physical injuries and mental distress caused  by the negligence of the MTA\Metro North Railroad and its employees.
