Brother Color Printer Defective Cartridge Recall Attorneys

The firm is co-counsel in a class action against Brother International Corporation (“Brother”). This consumer class action is brought on behalf of all persons and entities in New Jersey that purchased certain Brother color printers and Brother color toner cartridges for these printers. The printers involved are model numbers: HL-4070CDW/4040CN/4040CDN/4050CDN, DCP-9040CN/9042CDN/9045CDN and MFC-9440CN/9450CDN/9840CDW. The color toner cartridges covered in the suit are TN-110 and/or TN-115.

The suit alleges that Brother sold printers designed to be rendered inoperable when only one of the three independent color cartridges is exhausted. Consumers are then forced to buy replacement cartridges for all three colors to make the printers operable. At an approximate cost of $74 for each cartridge, the consumer must spend more than $220 each time one color cartridge runs out of ink, regardless of the ink levels in the other two cartridges.
