The National Highway Traffic Safety Administration (NHTSA) issued an advisory in October urging owners to get the airbags replaced if they live in certain geographical areas with high humidity. However, safety experts are pushing for a nationwide recall that could take place soon.
So far, there has been one wrongful death lawsuit filed by the family of a victim in Florida who allegedly died after she had metal and plastic sprayed into her neck by her airbag following an accident.
In addition to the wrongful death lawsuit, eight people have filed complaints seeking class-action status against Takata, claiming the company discovered the defect in tests back in 2004. The plaintiffs have alleged that Takata allegedly destroyed documents relating to the tests.
The plaintiffs are seeking compensation “on behalf of anyone in the U.S. who purchased or leased a vehicles with Takata airbags, as well as unspecified money damages and other relief,” according to the Consumerist.
The plaintiffs allege that their vehicles have also been devalued because of the recall.
