According to BevNet.com, Red Bull GmbH, the maker of the popular energy drink has agreed to a $13 million settlement in a class action lawsuit that accused it of falsely advertising its products.

The website reported that the settlement will require Red Bull to place $6.5 million into a settlement fund, which will be used to pay back consumers who purchased at least one Red Bull can over the past 10 years, offering class members the option of a $10 cash reimbursement or two free Red Bull products.

The lawsuit argued that Red Bull mislead consumers about its energy drinks, which it claims increase performance, concentration and reaction speed. Plaintiffs’ argued that the drinks only supply energy through caffeine and that these claims were false.

The lawsuit alleged that a small cup of coffee actually contains more caffeine than a Red Bull drink.

“Even though there is a lack of genuine scientific support for a claim that Red Bull branded energy drinks provide any more benefit to a consumer than a cup of coffee, the Red Bull defendants persistently and pervasively market their product as a superior source of ‘energy’ worthy of a premium price over a cup of coffee or other sources of caffeine,” the lawsuit said, according to BevNet.com.
